Welcome to Odyllon.com (hereinafter referred to as the "Site"). Access to and use of this Site, as well as any order of products (hereinafter referred to as "Products") placed via the Site, are governed by these Terms and Conditions of Sale (hereinafter "T&Cs"). Please read these T&Cs carefully before using the Site or placing an order. By accessing, browsing, or using this Site, you agree to be bound by these T&Cs in their entirety. Acceptance of these T&Cs constitutes a legal agreement between you, the user, and Odyllon. If you do not accept these terms, you may not use the Site to place an order.

We recommend that you print or save a copy of these T&Cs for future reference.

   Odyllon reserves the right to modify these T&Cs at any time. Any modifications will be published on this page, with an updated date. It is your responsibility to regularly check these T&Cs to stay informed of any changes. Continued use of the Site after any modifications constitutes your acceptance of the revised T&Cs.
   
   
3. CONDITIONS OF USE OF THE SITE
   Odyllon grants you a limited license to use this Site for personal purposes. Any reproduction, duplication, copying, selling, or commercial exploitation of the Site's content, including product listings, descriptions, images, or any derived use, is strictly prohibited without Odyllon's express written permission.

By using the Site, you consent to the use of cookies and similar technologies for analytics and personalized advertising, in accordance with our Cookie Policy and Privacy Policy. This includes tools like Meta's Conversion API, used to enhance your experience and provide tailored advertisements on platforms such as Facebook and Instagram.

Prohibited Use
The use of the Site is subject to certain restrictions aimed at protecting the integrity of our platform and the rights of other users. You may not:

• Attempt to circumvent any security or technological measures in place on the Site;
• Use automated tools, such as robots, spiders, or scripts, to extract or retrieve information from the Site;
• Modify, copy, distribute, or create derivative works from the content of the Site without Odyllon’s express permission;
• Harass, defame, or violate the rights of other users, including their privacy rights;
• Use the Site for resale or commercial purposes without prior written authorization from Odyllon;

Order Modifications and Cancellations
Once an order has been placed, it cannot be modified or canceled. However, you can return your product for free and place a new order in accordance with our return policy.

4. INTELLECTUAL PROPERTY
   All content on the Site, including text, graphics, logos, icons, images, audio and video clips, digital downloads, data compilations, software, and trademarks, is the property of Odyllon or its content suppliers. Any reproduction, distribution, transmission, modification, or use of this content for commercial or other purposes without Odyllon's express written consent is strictly prohibited. This includes product designs, registered trademarks, and any specific creations related to Odyllon. Any attempt to infringe on, counterfeit, or violate Odyllon’s intellectual property will result in legal action in accordance with applicable laws.
   
   Any attempt to interfere with the functioning of our analytical tools or advertising systems, such as disabling necessary cookies or bypassing tracking technologies in an unauthorized manner, is strictly prohibited and may result in legal action.

5. SALES CHANNELS
   Odyllon products are sold exclusively via the Website. No orders are accepted by phone, video conference, or any other channel. All orders must be placed online through the Site.
6. PRODUCTS AND AVAILABILITY
   The products displayed on the Site are offered subject to availability. In the event that a product becomes unavailable after order confirmation, Odyllon will refund you as soon as possible.
   
   Color and Description Variations
   We do our best to ensure that the colors of the products displayed on the Site are true to their actual appearance. However, variations may occur depending on individual display settings (brightness, contrast, etc.). Therefore, the colors of the products you receive may differ slightly from those shown online. These differences will not be considered defects.
   
   While we strive to provide accurate product descriptions, some information may be approximate. Odyllon cannot be held liable for minor errors or omissions in product descriptions as long as these do not affect the essential characteristics of the product.
   
   Personal Use and Prohibition on Resale
   Odyllon does not offer personalized items, and all products must be used for personal purposes only, not for resale or commercial purposes. Any attempt to resell products is strictly prohibited.

7. PRICES AND PAYMENT TERMS
   7.1 Prices
   All prices displayed on the Site are in euros and include applicable VAT. VAT is automatically calculated based on the delivery country selected at the time of ordering. Odyllon reserves the right to modify product prices at any time, but the prices charged will be those in effect at the time of the order.
   Shipping costs within the European Economic Area (EEA) are free of charge.
   
   7.2 Price and Description Errors
   In the event of a clear error in the displayed price or product description (including images), Odyllon reserves the right to refuse the order or propose a correction. If an error is detected after your order, Odyllon will contact you to offer the option of canceling or confirming your order with the corrected information. Obvious errors in descriptions, prices, or illustrations do not bind Odyllon, and we reserve the right to make corrections at any time.
   
   7.3 Payment Terms
   Orders must be paid in full before shipping. Odyllon accepts payments via credit card. Partial or installment payments are not accepted.

8. ORDERING
   By placing an order on the Site, you agree to these T&Cs and confirm that you are at least 18 years old. You can place an order as a guest or through a customer account. Once an order is placed, it cannot be modified or canceled. However, free returns are available if you wish to return your items and place a new order. After confirming your order, you will receive an email acknowledging receipt of your order, but this acknowledgment does not constitute acceptance of the order. The sale is concluded only when you receive a shipping confirmation from Odyllon. Odyllon reserves the right to revoke or refuse any order for valid reasons, such as product unavailability, a manifest pricing error, or unverifiable payment information. The sale will only be concluded upon the dispatch of the shipping confirmation.
   
   
9. CUSTOMER ACCOUNT CREATION AND MANAGEMENT
   9.1 Account Creation
   You have the option to create a personal account on Odyllon via Shopify. To create an account, you must provide certain personal information, such as your first name, last name, email address, and delivery address. This information is processed in accordance with Odyllon's Privacy Policy.
   
   9.2 Credential Management
   When creating your account, you will be asked to choose a password. You are responsible for the security of your login credentials and must keep them confidential. Odyllon will not be liable for any actions taken with your account if your credentials are compromised.
   
   9.3 Information Modification
   You may modify your personal information at any time by logging into your account. In the event of a loss or theft of your credentials, it is imperative that you change them immediately.

10. LIMITATION OF QUANTITIES
    At Odyllon, we encourage responsible and sustainable consumption. To ensure fair availability of our products and prevent excess orders for "testing" or resale purposes, we have implemented quantity restrictions per product and per customer.
    Odyllon reserves the right to refuse or cancel orders that violate this policy, especially if an order is excessive or incompatible with our slow fashion philosophy. We encourage you to carefully review your choices before placing an order and to consult our size guides to limit returns due to selection errors.
    In case of non-compliance with these restrictions, Odyllon may, at its sole discretion, limit or refuse any future order from the same customer.
    
    
11. SHIPPING
    11.1 Shipping Area
    Odyllon only delivers within the European Economic Area (EEA) to residential addresses. Deliveries cannot be made to PO boxes or non-residential addresses such as hotels or forwarding services. Odyllon does not deliver to anonymous or temporary addresses.
    
    11.2 Delivery Times
    Orders are generally shipped within 1 to 3 business days, with delivery estimates ranging between 2 to 5 business days. Delivery times may vary depending on your location, peak periods, or unforeseen events (such as strikes). You will receive an email with tracking information as soon as your order is dispatched.
    
    11.3 Fees for Uncollected or Refused Packages
    If you fail to collect your package or refuse delivery, a fee of €20 will be charged to cover handling costs. If a new delivery attempt is required, additional fees corresponding to transportation costs will also be charged. If you choose to cancel your order after a failed delivery, only the €20 handling fee will be deducted from your refund.

12. RIGHT OF WITHDRAWAL AND RETURNS
    12.1 Return Conditions
    You have 30 days from the date of delivery to return a product, provided it is new, unused, in its original packaging, with all tags intact, including the cord that must not be cut. Returns that do not meet these conditions may be refused.
    
    As part of our sustainability commitment, we encourage thoughtful purchasing decisions to reduce returns and their environmental impact. By choosing Odyllon, you are investing in timeless, durable pieces that align with a sustainable philosophy.
    
    12.2 Return Fees
    Returns are free if the products meet the return conditions and are made within 30 days of delivery. If a return does not meet these criteria, the item will be sent back to the customer at their expense. Odyllon will provide a return label to print, and the return shipping costs will be calculated by Odyllon, at the customer’s expense, plus a €20 handling fee.
    
    12.3 Refunds
    Refunds are processed within 14 business days once the returned items are inspected and approved by Odyllon. If the return criteria are not met, a €20 handling fee will be deducted from the refund, and return shipping costs will also be at the customer's expense.
    
    12.4 Exchange Policy
    As part of our commitment to sustainable practices, Odyllon does not offer direct exchanges. We encourage our customers to adopt thoughtful shopping habits that align with our values. If you ordered the wrong size or wish for another product, you may return the unwanted item for free and place a new order. However, we believe that conscious purchasing decisions help reduce waste and support a more sustainable future. By choosing wisely, you contribute to the preservation of the environment and resources for future generations. Returns are subject to our standard conditions, as described in the withdrawal section.

13. TRANSFER OF OWNERSHIP
    Products remain the property of Odyllon until full payment for the order has been received. In the event of non-payment, Odyllon reserves the right to reclaim the delivered goods. Once the order has been delivered to the specified address or in accordance with your delivery instructions, responsibility for the products is transferred to you. This means you are responsible for the products once they have been delivered, including in the event of theft, loss, or damage. Odyllon will not be held responsible for losses or damages incurred after delivery. It is your responsibility to provide a correct delivery address and ensure the receipt of the products.
    
    
14. WARRANTY AND COMPLIANCE
    Odyllon products are covered by the minimum legal warranty required by law. In the event of a defect or non-compliance of a product, the customer must contact Odyllon with details of the defect and photos in order to resolve the issue. Odyllon may request the return of the product for inspection and will arrange for a replacement or refund as appropriate.
    
    Limitation of Liability
    To the extent permitted by law, Odyllon limits its liability to the total value of the order in the event of direct or indirect damages resulting from the use of its products. Odyllon shall not be held liable for any unforeseeable loss or damage, any indirect damage, loss of profit, or loss of data. These limitations of liability do not affect the consumer's legal rights regarding the product warranty.

15. FORCE MAJEURE
    Odyllon will not be held liable for delays or failures in the performance of its obligations in the event of force majeure, as defined by applicable law. Force majeure refers to any event beyond Odyllon's reasonable control, including but not limited to: strikes, natural disasters, acts of war, terrorist attacks, pandemics, fires, floods, storms, power outages, telecommunications service failures, cyberattacks, government restrictions, transport disruptions, and any other unforeseeable event beyond Odyllon’s control that renders it impossible to fulfill its obligations. In the event of force majeure, Odyllon reserves the right to suspend or postpone the performance of its obligations for the duration of the event. If the force majeure event lasts longer than two months, either Odyllon or the customer may choose to terminate the contract without penalty, subject to written notice.
    
    
16. PRIVACY AND DATA PROTECTION
    At Odyllon, the protection of your personal data is a top priority. We do not commercialize any personal information and only use your data for the management of your orders. Only service providers directly involved in processing your orders, such as banking institutions, delivery services, and Shopify—the platform we use to manage our online store—have access to your information, and only for payment and shipping purposes.
    Your data is processed in accordance with the data protection laws in force. Shopify, as a service provider, also offers customers the option to request the deletion of their personal information, in accordance with applicable law. You can request the deletion of your account or data by contacting our customer service at the following address: contact@odyllon.com.
    Odyllon does not sell your personal data to third parties. You have the right to access, rectify, oppose, and delete your personal data, in accordance with legal provisions.
    
    As part of our commitment to transparency, we use advanced tools such as Meta's Conversion API to analyze purchasing behavior and enhance your shopping experience. This includes personalized advertisements on social networks like Facebook and Instagram, tailored to your interests and browsing habits.

17. ORDER REFUSAL
    Odyllon reserves the right to refuse any order that presents fraudulent elements, irregularities, or behaviors deemed incompatible with the brand's values. This includes abusive behavior related to excessive or multiple returns, or any attempt to use the products for purposes other than personal use. Odyllon also reserves the right to refuse an order from a customer with whom a dispute over a previous order is ongoing. All such decisions are at Odyllon’s sole discretion.
    
    Odyllon reserves the right to refuse any order that conflicts with its values of sustainability and exclusivity. This includes excessive or fraudulent returns, attempts to purchase products for resale, or any misuse of promotional tools such as advertising platforms linked to Odyllon's campaigns.

18. APPLICABLE LAW AND JURISDICTION
    These T&Cs are governed by Belgian law. In the event of a dispute regarding the interpretation or execution of these T&Cs, the courts of Brussels shall have exclusive jurisdiction.
